These Special Terms and Conditions relate only to the online shopping facility for Spare Parts on this Site, in addition to our General Terms and Conditions, which are also on this Site, and where there is any conflict or inconsistency between them, these Terms will prevail.
Contract
All your orders and purchases made through this Site will be with Heritage Bathrooms, as a division of Bristan Group Limited, and not with any other party, including the retailer whose web site may have directed you to this Site.
Prices
The prices payable for the Spare Parts are those shown on this Site at the time when your order is placed. All the prices are in pounds sterling, and include VAT. Delivery and packaging is included in the prices, unless otherwise stated in these Terms and Conditions.
Availability
The Spare Parts are offered subject to availability, and we reserve the right to substitute Spare Parts of similar specification and quality. If for any reason we are unable to supply a Spare Part that you have ordered or a substitute [within our normal despatch period], we will notify you [by email] as soon as possible.
Although we will refund the costs of the return to us in good condition of any substitute Spare Parts which are not acceptable to you, we will not be liable to you for any loss or expense incurred as a result of a Spare Part not being available.
Acceptance
There will be no contract between you and us unless and until we despatch the Spare Parts to you, when an email will be sent to you to notify you that the Spare Parts have been despatched. At this point, the contract for their supply will be entered into between you and us. At any time until then, we may decline to supply the Spare Parts to you without giving any reason, and we will notify you [by email] as soon as possible. If we decline to supply any of the Spare Parts, and payment has already been taken from your credit or debit card, we will credit your credit or debit card with the price of the Spare Parts concerned within 30 days of having declined your order, but we will not have any liablity to you for compensation for disappointment suffered or otherwise.
Delivery
The Spare Parts will be delivered to you to the address given in your order. Once the Spare Parts have been delivered, they will be at your risk, and we will not be liable for their loss or damage. You must inspect the Spare Parts on delivery, and if any of them are damaged, incorrect or missing, you must email to tell us within 7 working days of delivery, or if nothing has by then been delivered, the date of our email notifying you that they have been despatched. You must give us a fair chance to inspect Spare Parts that you tell us have been delivered damaged or are incorrect.
Please note that we can only deliver within England, Scotland and Wales, and even then it may not be possible to deliver to some addresses[, in which case we will email you to ask for alternative delivery instructions]. All deliveries are made by third party carriers. If the carrier is not able to make delivery of the Spare Parts at the address you have given at any time between 8.00am and 6.00pm Monday to Friday, they will either be stored at the carrier’s depot nearest that address until you can collect them, or the carrier will attempt to redeliver them to that address.
Although the Spare Parts will normally be despatched within 3 working days of the date of order, we will not be liable for loss or expense incurred as a result of delay in delivery arising out of any cause whatsoever.
If you order Spare Parts with different availability dates, we will hold them until the last one is available for delivery.

If you cancel your order as above, the Spare Parts must be returned to the above address at your own cost within 30 days of cancellation. It is your responsibility to take reasonable care of the Spare Parts while they are in your possession.
Returns
If the Spare Parts are incorrect, faulty or damaged, we will collect them at our discretion, and they must be available for collection by a third party carrier at any time between 8.00am and 6.00pm Monday to Friday.
Payment
You can pay by VISA, MasterCard, Switch, Solo, American Express & VISA Electron. Your credit or debit card details will be encrypted to minimise the possibility of unauthorised access or disclosure. By clicking the Confirm Order button you authorise and give consent to us taking the total payment as quoted from your nominated credit or debit card.
Spare Parts Guarantee
We warrant that the Spare Parts will be free from defects for a period of twelve months from
delivery, except for accidental or malicious damage, improper use or negligence, general wear
and tear, damage due to poor installation or servicing, and we accept no liability for
consequential loss.

General
These Special Terms and Conditions will be governed by English Law, and in the event of any disputes, the English and Welsh courts have exclusive jurisdiction.
These Special Terms and Conditions will not affect your Statutory Rights.
